May, 2009. Notification was received
that the Spanish Embassy had denied in September, 2008 the request of Gray &
Pape, cultural resource managers of Richmond, VA. to do a non-intrusive
magnetic survey on United States soil within the Chincoteague National
Wildlife Refuge. "We are therefore unable to conclude that it would be
appropriate to approve this application." But after that on January 26,
2009, Spain told the federal court in Tampa that
La Galga "lies scattered and buried in the sand beneath the water.”
If that was true then why the denial to map a site on land?

La Galga referred to as legal precedent against Odyssey Marine . See

The New Yorker this month has a feature story
about Odyssey Marine. The story is entitled, "Secrets of the Deep," by John
Colapinto. Colapinto says incorrectly that La Galga and the Juno
were salvaged by Sea Hunt. The
Hidden Galleon sets that story straight..

Attorneys for the
Kingdom of Spain filed an "Opposed Motion of Claimant the Kingdom of Spain
for a more definitive statement and Other
Disclosure, or in
the Alternative, to Dismiss" in the Odyssey Marine Exploration case. The
purpose is to make Odyssey disclose what they found and where they found it
pursuant to the rules of the Admiralty Court. Spain cited as precedent their
victory in the case of La Galga and the Juno in 2000. They
claimed that their motion was "consistent with long standing international
and U. S. law and recent case law
specifically
affirming the application of these principles to sunken Spanish property."
Should these so-called precedents be allowed to stand if the court that made
them lacked legal jurisdiction?
May 31, 2007
Odyssey Marine
Exploration recently brought in 17 tons of gold and silver coins where it
was placed under the protection of the federal court in Tampa Florida. On
May 30, 2007 the Kingdom of Spain filed a claim in that court in the event
the treasure might have come from from a Spanish wreck. The news from
Madrid, Spain via the AP, says that the same attorneys who represented
Spain in their 2000 victory over La Galga and
the Juno will pursue Spain's interest in the
$500 million. Perhaps they feel empowered by that so-called legal precedent.
